1. Acceptance
By downloading or using Ascent Physique ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.
2. The service
Ascent Physique is a fitness and nutrition tracking app. It lets you follow workout plans, log workouts and meals, track body weight and progress, and — optionally — use AI features to estimate nutrition and generate coaching insights. The App stores your data on your device; see the Privacy Policy for how optional AI features transmit data.
3. Not medical or professional advice
The App, including any AI-generated guidance, is for general fitness and informational purposes only and is not medical, nutritional, or professional advice. Calorie/macro estimates and coaching insights are approximations and may be inaccurate. Consult a qualified professional before starting any exercise or nutrition program, especially if you have a health condition, are pregnant, or are injured. You exercise and follow any plan at your own risk.
4. Eligibility
You must be at least 18 years old to use the App. The App provides training and nutrition guidance intended for adults, and is not offered to minors.
5. Subscriptions and payments
- The App offers an optional auto-renewing premium subscription (monthly and annual plans) sold through the Apple App Store, whose terms also apply.
- Payment is charged to your store account at confirmation of purchase.
- The subscription auto-renews unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your App Store account settings. If a free trial is offered, any unused free-trial portion is forfeited when you purchase a subscription.
- Prices are shown in the App and may vary by region; we may change prices with notice per store rules.
- Refunds are handled by the store under its policies; we generally cannot issue refunds directly.
6. Your content and data
You retain ownership of the data you enter. You're responsible for the accuracy of what you log. You grant us only the limited rights needed to operate the App's features (e.g., sending a food photo you choose to scan to our processing service). See the Privacy Policy.
7. Acceptable use
Don't: reverse-engineer or tamper with the App; abuse, overload, or attempt to bypass the AI backend's limits; use the App for any unlawful purpose; or attempt to access the service other than through the App's normal interface.
8. Intellectual property
The App, its content, plans, and branding are owned by Adrian Kumar (trading as Ascent Physique) and protected by applicable laws. These Terms grant you a personal, non-transferable, non-exclusive licence to use the App; no other rights are granted.
9. Third-party services
AI features use third-party processors (Cloudflare, Google Gemini), and barcode lookups use Open Food Facts; your use of those features is also subject to their terms. We are not responsible for third-party services.
10. Disclaimers and limitation of liability
The App is provided "as is" and "as available," without warranties of any kind. To the maximum extent permitted by law, Adrian Kumar is not liable for any indirect, incidental, or consequential damages, or for any injury, loss, or harm arising from your use of the App or reliance on its content. To the extent such liability cannot be excluded, our total liability to you for all claims arising out of or relating to the App is limited to the total amount you paid for the App in the twelve (12) months before the claim arose.
11. Termination
We may suspend or terminate access for breach of these Terms. You may stop using the App at any time; subscription cancellation is handled through your store account.
12. Changes
We may update these Terms; material changes will be noted with a new "Last updated" date. Continued use after changes means you accept them.
13. Governing law
These Terms are governed by the laws of South Australia and the Commonwealth of Australia applying in that State, without regard to conflict of laws rules. You submit to the non-exclusive jurisdiction of the courts of South Australia. Nothing in these Terms excludes, restricts or modifies any right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
